Clinical Privileges

Although the Texas Medical Board has the ultimate authority for licensing and disciplining physicians; hospitals have substantial power in the restriction of a physician’s ability to practice through the granting of medical privileges. Hospitals have a duty to patients to allow only qualified physicians and surgeons on their medical staff. This is generally accomplished by the application process and then maintained through peer-review. If the hospital fails to fulfill the duty, it can be found liable for physician negligence. Hospital liability to the patient for physician negligence does not reduce the physician liability to the patient; it is additional to that of the physician. The objective of the granting, denying or termination of hospital privileges is to benefit the patient, but situations frequently arise where privilege denials and terminations occur for other reasons.
